다른 사람의 행위로 인하여 피해를 입었다면 그에 대한 정의를 추구하고자 하는 것이 지극히 당연합니다. 하지만 추후 어떠한 절차를 밟아야 하는지를 알기 위해서는 먼저 본인에게 행해진 부당한 행위가 민사상 불법 행위인지 형사상 범죄인지를 알아야 합니다.

어떠한 사람이 형사상 범죄를 저질렀는지를 쉽게 알아보는 가장 쉬운 방법은 스스로에게 다음의 질문을 던져보는 것입니다: “불법 행위자가 나를 해하려는 의도를 가지고 해당 행위를 저질렀는가?” 만약 답이 “예”라면 해당 사건은 형사 사건일 가능성이 높으며, 만약 답이 “아니오”라면 민사 사건일 가능성이 높습니다. 쉽지요? 이해를 돕기 위하여 몇 가지 질문을 드려보겠습니다.

질문 1: 아침에 존과 말다툼을 한 후 화가 난 스테판은 화에 몸을 맡기고 존의 얼굴을 구타하기로 결정하였습니다. 이는 민사 사건인가요 형사 사건인가요?
답: 스테판이 존을 구타하기 전에 그를 해하기로 마음 속으로 계획을 하였으므로 형사 사건입니다.

질문 2: 의사와의 면담 시간에 늦은 데이빗은 차에서 내린 후 병원을 향해 달려가기 시작했습니다. 병원에 거의 다 왔음을 알리기 위하여, 데이빗은 달리면서 의사에게 문자를 보내기로 결정했습니다. 휴대폰을 보던 중 데이빗은 뜻하지 않게 출입문 가까이에 서 있던 남자 아이에게 부딪히고 말았습니다. 그 결과 남자 아이는 굴러 떨어져 팔에 타박상을 입었습니다. 이는 민사 사건인가요 형사 사건인가요?
답: 데이빗은 남자 아이에게 해를 입히려는 의도가 없었으므로 형사 사건이 아닙니다. 그러나 여전히 데이빗의 과실임으로 데이빗은 민사상 책임이 있습니다.

질문 3: 앤드류는 한도 40,000달러의 비자 골드 신용카드를 보유하고 있습니다. 앤드류는 최근 참석한 개인 자금 관리 세미나에서 캐나다 온타리오 주에서의 파산 신청은 합법적일 뿐만 아니라, 때로는 재정 자문가가 이를 추천하기도 한다는 사실을 알게 되었습니다. 이러한 지식에 기초하여 앤드류는 2주간의 호화로운 휴가를 떠나 비자 카드로 35,000달러를 결제하여 신용 카드 한도를 넘기기로 결정하였습니다. 한 달 후 앤드류는 파산 신청을 제기하였습니다. 신용카드 한도를 넘기고 파산 신청을 하는 것은 형사상 범죄일까요?
답: 신용 카드 대금을 지불하지 못한 개인의 파산 신청은 드물지 않습니다. 그러나 앤드류가 파산 신청 직전에 카드 한도를 초과하기로 계획했다는 사실을 카드 회사가 증명할 수 있다면, 이는 파산 사기에 해당하여 형사상 책임을 질 수도 있습니다.

결국 민사 사건과 형사 사건의 차이는 무엇일까요? 불법 행위자가 타인에게 피해나 손해를 끼치려는 의도로 사전에 계획을 했다면 이는 형사 사건입니다.  불법 행위자가 실수로 타인에게 피해나 손해를 끼쳤다면 이는 민사 사건입니다. 혹시 추후에 좋지 않은 일을 당하게 된다면, 경찰에게 연락할지 민사 소송 변호사에게 연락할지를 결정하기 전에 본인이 민사상 피해자인지 형사상 피해자인지를 먼저 검토해보시기 바랍니다.


When you have been wronged by another person's actions, it is only natural to want to seek justice.  But you will need to know if the injustice committed against you is civil or criminal in order to know what steps you will need to take next.

The easiest way to determine if a person committed a criminal act is to ask yourself the question, “Did the wrongdoer commit the act to hurt you on purpose?”  If the answer to this question is “yes” then it is likely a criminal matter, and if the answer is “no” then it is likely a civil matter.  Easy, isn’t it? Here are some questions you can try to see if you get it.

Question 1: Stephen was upset with John after having an argument in the morning and decided to let out his anger by punching him in the face.  Is this civil or criminal?
Answer: This is criminal since Stephen planned in his mind to hurt John before punching him.

Question 2: David was late for his doctor’s appointment so he started running towards the hospital after getting out of his car.  In order to let his doctor know that he is nearby he decided to text him while running.  As he looked down at his cell phone he accidentally ran into a boy standing near the entrance door.  The boy ended up falling down and suffered bruising on his arm.  Is this civil or criminal?
Answer: This is not a criminal matter because David did not intend to cause injuries to the boy but he is still civilly responsible because it was his fault regardless.

Question 3: Andrew had a VISA Gold credit card with a credit limit of $40,000.  After attending a recent seminar on personal money management, Andrew learned that filing for bankruptcy in Ontario is not only legal but is encouraged in some situations by financial advisors.  Armed with this knowledge, Andrew decided to max out his credit card by going on an extravagant 2-week vacation costing him $35,000 on his VISA.  He filed for bankruptcy a month later.  Is it criminal to max out your credit card and filing for bankruptcy?
Answer: It is not uncommon for individuals to file for personal bankruptcy because of their inability to pay the credit card balance.  However, it is a bankruptcy fraud and may be criminal if the credit card company can show that Andrew had planned to max out his credit card just before filing for bankruptcy.  

So what is the difference between a civil and criminal matter? 

It is a criminal matter if the wrongdoer had planned ahead of time to hurt or deprive another person.  And it is a civil matter if the wrongdoer mistakenly hurts or deprives another person.  So next time you find yourself in a bad situation, ask yourself if you have been a victim of a crime or civil wrong before deciding if you should call the police or a civil litigation lawyer.
