보석이란 무엇인가?

상상해 보십시요.  새벽 3시 반에 전화벨이 울립니다. 잠이 덜 깬 채로 무슨 일인가 싶습니다. 누구의 전화일까? 한국에 있는 친척을 문득 떠올리며 왜 그리 이른 시각에 전화하는지 살짝 짜증이 납니다. 그리고는 ‘음성메세지로 넘어 가도록 할까’ 하고 생각하여 봅니다. 허나, 중요한 전화라면? 만약 한국으로부터의 어떠한 좋은 소식이라면?

전화를 받기로 하고 ‘여보세요’  한 후 친척들 중 누군가의 친근한 목소리를 기다립니다. 하지만 뭔가 이상합니다. 상대방은 잠시 응답이 없고, 뒤에 사람들이 소리치는게 들리지만 무슨 말을 하는지는 알아들을 수 없습니다. 그리고는 어떠한 이가 “저는 순경Smith 입니다. 김모모씨 댁 맞습니까?” 라고 말합니다.

당신은 그 경찰관과의 통화를 통하여 그 지역 클럽에서 발생한 사건에서 당신의 19살 짜리 아들이 무기를 사용한 폭행죄로 고발되어 체포 되었음을 알게 됩니다. 그 뿐이 아닙니다. 경찰관은 아들이 그 날 밤을 경찰서에서 보내고 다음날 아침에 법정에 가야한다고 말합니다. 경찰관은 아침에 법원에 방문하여 보석을 통하여 아들을 데려오는 것이 좋을 것이라는 말 외에는 별다른 정보를 공유하지 않습니다.

이는 현 형법제도하에서 너무나도 흔하게 벌어지는 상황입니다. 이와 더불어, 이것은 경험 할 수 있는 가장 충격적인 경험들 중 하나가 될 수 있습니다. 우리의 소중한 이가 거리에서 다친다거나 범죄의 피해자가 되었을 시, 경찰 및 의료진은 우리가 안심 할 수 있도록 서슴없이 도움을 주고 최대한 많은 정보를 제공합니다. 가장 혼란스러울 순간에 그들은 온정을 베풉니다. 허나, 집에 전화를 걸어 가족 중에 누가 체포되었음을 알릴 시에는 대개 상황이 다릅니다. 어찌됬든 경찰은 당신의 아들을 수감하고자 하는국가의 대리인이니까요.

위의 시나리오에서 경찰은 아침에 보석 청문회를 진행하기 위하여 아들을 수감하기로 결정하였습니다.

이론상, 보석제도는 일반대중을 보호하기 위하여 존재하며 경찰은 용의자 체포시 보석 청문회를 진행할지의 여부를 결정하는 고유 권한을 가집니다. 경찰은 체포를 완료한 후 용의자를 곧바로 풀어줄 경우의 잠재적 위험을 따져보아야 할 것입니다. 예를 들어용의자가 한 달 전 경에 가게에서 휴대전화기를 절도한 혐의로 체포된 사람이라면 경찰은 아마도 용의자에게 필요한 법원 서류 등을 주고 절도혐의에 관하여 변호하기 위하여 정해진 날짜에 법정에 가야함을 당부하며 집에 보낼 것 입니다.

허나, 폭력이 사용된 심각한 사건이라면 용의자가 피해자에게 재차 범행를 저지르거나 사건을 경찰에 신고한 이등에 복수하는 일이 없도록 각별히 경계할 필요가 있습니다. 이러한 사건들의 경우 피해자 및 목격자 등을 보호하기 위하여 경찰은 용의자를 유치하고자 할 것 입니다.

법은 경찰이 용의자 체포 후 24시간 내로 보석 청문회가 진행 될 수 있도록 용의자를 법정에 바로 이송할 의무가 있습니다. 이것이 새벽에 체포된 지 몇 시간 지나지 않았음에도 불구하고 아침에 바로 보석 청문회를 여는 이유입니다.

보석 청문회는 대개 실제 재판과 유사하게 진행되며 검사는 사건이 종료 될 시 까지 용의자를 유치하고자 주장하고 피고측은 피고인을 풀어줘도 공중의 안전이 위험에 놓이지 않을 것 이라 주장합니다. 대부분의 경우 피고측은 피고인을 보증하는 보증인을 제안합니다. 보증인은 대체로 생부 및 피고인보다 나이가 훨씬 많은 가족의 면밀한 지인같이 피고인에게 권위를 갖는 인물입니다. 만약 법정이 허가 할 경우 보증인은 법정이 부여한 보석 조건 등을 피고인이 준수함을 보장할 책임을 갖습니다. 전형적인 보석 조건에는 피해자에게 연락 금지, 종결시까지 보증인과 거주와 같은 조건 등이 포함됩니다.

보석 석방의 중요성은 아무리 강조해도 지나침이 없습니다. 토론토 대도시권의 많은 한인들이 대면하는 전형적인 형사 사건은 종결까지 일년이 넘게 걸릴 수 있으니 보석 석방을 받지 않는 것은 고발된 사람이 재판을 받기도 전에 일년이나 수감될 수 있음을 의미합니다. 보석 석방 없이수감된 피고인등은 변호인과의 협력에 어려움을 겪을 뿐 아니라, 여러 연구에 따르면 더 쉽게 포기하고 유죄를 인정하기 마련이라고 합니다.

What is Bail?

Picture this.  It’s 3:30 in the morning and you get a telephone call.  Only half asleep, you try to figure out what is going on.  Who could be calling? You wonder for a split second if it’s a phone call from a relative in Korea and get slightly annoyed as to why they are calling you so early in the morning.  Then you think to yourself, ‘Maybe I’ll let it go to voicemail.  But what if it’s something important?  What if it’s some good news from Korea?

You decide to pickup the phone and after uttering “hello” you wait in anticipation to hear a friendly voice from one of your relatives.  But something doesn’t sound quite right.  There is a slight pause on the other side of the line and you also hear people shouting on the background and can’t quite make out what is being said.  Then you hear a man come on to say “This is police constable A. Smith, is this the home of Mr. Kim?”

You later learn from speaking to the police officer that your 19 year old son was just arrested for an incident which occurred at a local nightclub and he was charged with assaulting another person with a weapon.  What’s worse?  The officer tells you that he will have to keep your son overnight at the police station and take him to court tomorrow morning.  The officer does not provide much information other than the fact that you may want to go to court to bail him out in the morning.

This is a situation that is all too familiar in the world of criminal justice.  And this can be one of the most devastating events one can experience.  You see, when our loved ones get injured on the street or have become victims of criminal offence, the police and medical staff will be quick to help you and provide as much information as possible to put you at ease.  They will exercise compassion in the time of great confusion.  But this is not usually the case when the police calls your home to tell you that one of your family members have been arrested.  Afterall, the police is an agent of the state whose interest is in keeping your son in jail. 

What just happened in the above scenario is that the police has decided to keep your son in jail in order to proceed to bail hearing in the morning. 

In theory, the bail system exists in order to protect the public at large and police has the sole discretion to determine if bail hearing should be held upon arresting a suspect.  After an arrest is made, the police will have to determine the potential risk associated with releasing the suspect back into the community right away.  As an example, if one had been arrested for allegedly stealing a cell phone from a store about a month ago the police is likely to give the suspect the necessary court documents and send him home with a reminder that he will have to go to court on a specified date to answer to the charge of phone theft.  But in serious cases where violence was used the police will need to be extra vigilant to ensure that the suspect does not go running back to the victim to reoffend or to seek revenge on individuals who reported the incident to the police.  In these cases the police will insist on holding the suspect in jail in order to protect the victims and witnesses.  

The law requires the police to bring the suspect to court for a bail hearing within the first 24 hours of being detained.  And this is the reason why a bail hearing would commence in the morning right away despite the fact that an arrest happened only a few hours ago early in the morning.

A bail hearing typically looks like a full-blown trial where the prosecutor will argue in favour of detaining the suspect until the criminal case is completed and the defence will argue that public safety would not be in jeopardy despite the suspect being released back into the community.  In most cases, the defence will propose a surety to vouch for the suspect.  A surety would often be an individual who is an authoritative figure to the suspect, such as the biological father or a close friend of the family who is also much older than the suspect.  If approved by the court, the surety bears the responsibility to ensure that the suspect complies with the bail conditions set by the court.  Typical bail conditions would include terms prohibiting the suspect from contacting the victim and a condition that he resides with his surety until the case is completed.

The importance of getting released on bail can’t be stressed enough.  A typical criminal case many Koreans face in the Greater Toronto Area can take more than a full year to complete so not getting bail could potentially mean that person charged with an offence could stay in jail for a year before getting to trial.  Defendants incarcerated without bail often face difficulty working with lawyer and is more likely to give up and plead guilty according to various studies.
